Terms and Conditions

The following Terms and Conditions shall apply to all bookings for activities provided by “Gunfighters”. A booking will only be accepted upon receipt of signed confirmation, whether by fax, letter or email, from the “Organiser” which shall be acceptance of these Terms and Conditions.

In these Terms and Conditions, the following expressions shall have the following meaning:

“Gunfighters” Means “Gunfighters” operating from multiple UK sites.

“Organiser” Means the person who has signed the booking form, whether that person is taking part or not.

“Game Players” Means the people that will be taking part in activities organised by ”Gunfighters”.

“Game Players” must be at least 18 years of age to participate in activities organised by ”Gunfighters”.

“Game Date” Means the date on which activities are to be played, pursuant to a confirmed booking.

“Game Site” Means the location at which the activity will take place.

1. Payment.

1.1 Payment shall be by either cash or by those credit/debit cards that are considered acceptable by “Gunfighters”. The “Organiser” has the option to pay an initial deposit of no less than 50% of the overall booking, or whichever is the minimum deposit at the time of the booking, at any time to reserve a booking at their preferred "Game Site" and "Game Date" in advance if they so wish, subject to availability. However, full payment must be received by “Gunfighters” no less than 7 days before the “Game Date” unless otherwise stated.

1.2 Full payment of all fees must be made at least 7 days before the “Game Date” unless otherwise stated or agreed, otherwise “Gunfighters” may at its own discretion treat the booking as being cancelled and retain any deposits plus any direct costs paid in order to organise the “Game Date”. Any dispute concerning this agreement or the sums due shall not affect the obligations of the “Organiser” to pay all sums on the due date.

2. Cancellation.

2.1 If a booking is cancelled, then the following charges will be due:

Deposits are non refundable. Any additional monies paid in excess of the minimum deposits are refundable subject to condition.

“Gunfighters” will retain the right to alter or amend with these cancellation conditions at their own discretion at any time without notice.

3. Liability.

3.1 Save in relation to Death or Personal Injury caused by negligence on the part of “Gunfighters”, “Gunfighters” shall have no liability to the “Organiser”, “Game Players” or any Third Parties for indirect, special or consequential loss or damage (whether for loss of profits or otherwise), costs, expenses or claims for compensation whatsoever (whether caused by the negligence of “Gunfighters”, its employees or agents or otherwise) which arise out of or in connection with the provision of activities, and the entire liability of “Gunfighters” under or in connection with this agreement (other than in respect of Death or Personal Injury) shall not exceed the aggregate of all charges payable under this agreement. All “Game Players” are required to complete and sign a disclaimer prior to the commencement of activities provided by “Gunfighters”.

4. Charges.

4.1 “Gunfighters” reserves the right to vary at any time prior to the “Game Date” any of the facilities, services or prices described in either their brochure, magazine articles and other printed media, confirmation of booking letters flyers,  or online website. If a substantial change is made, “Gunfighters” will attempt to notify the “Organiser" as soon as possible prior to the “Game Date” but the “Organiser” will have no right to cancel the booking, where minor changes are imposed. “Gunfighters” will attempt to notify the “Organiser” as soon as possible prior to the “Game Date” but shall be under no obligation to do so.

4.2 “Gunfighters” reserves the right on the “Game Date” to postpone activities and any other services provided in the event of severe weather conditions or any matter relating to Health and Safety or any other circumstances beyond its control, and will attempt to notify the “Organiser” as soon as possible to offer an alternative “Game Date” or “Game Site” for the booking. In the event that no acceptable alternative “Game Date” or “Game Site” can be offered, then “Gunfighters” shall refund any deposits and additional monies paid to the “Organiser” without any further liability on the part of “Gunfighters”, and shall not be liable for any additional costs incurred by the “Organiser” or “Game Players”.

4.3 “Gunfighters” reserves the right to require any person(s) who in their discretion is behaving in an improper manner and whose actions are or may be a danger to the safety of themselves or other person(s) to leave the “Game Site” forthwith. Any person(s) dismissed shall not be entitled to any refund, and any fees paid by said person(s) (including deposit) shall be retained by “Gunfighters”. Any person(s) found to be deliberately damaging the property of “Gunfighters”, its employees, agents and associated owner(s) of the “Game Site” will be issued with a bill to repair or replace such property. Any person(s) that refuse to pay for any deliberate damage incurred will be pursued via the appropriate legal and lawful channels in order to recover such costs in relation to the damaged property and any legal fees that are subsequently accrued.

5. General.

5.1 If “Gunfighters” fails to provide activities at all, or provides a substantially different service, the total account shall be reduced by such reasonable amounts as “Gunfighters” shall in its discretion determine to reflect any changes but in no circumstances shall “Gunfighters” be liable to make any repayment or reduction in excess of all charges/fees due pursuant to clause 1.2.

5.2 If the “Organiser” fails to observe any obligations or breaches any condition under this contract then “Gunfighters” shall be entitled to determine this contract immediately and cancel the booking (such a breach is treated as a cancellation of the booking pursuant to clause 2). All monies owing on the due “Game Date” shall immediately become payable in accordance with clause 2 and “Gunfighters” will have no further liability.

6. Force Majeure.

6.1 Any failure to perform any obligation by either party (save on obligation in respect of the payment of monies) shall not constitute a breach of such obligations to the extent that such a failure is caused by an event such as extreme weather, fire or accident, or by imposition by any third party of any restrictions, regulations and by-laws, strike or other industrial action or trade dispute, or national emergency (whether involving “Gunfighters”, “Game Site”, its employees or those of a third party nature) outside the reasonable control of the party.

7. Governing Law.

7.1 This contract (including all matters arising from it) is subject to English Law and the exclusive jurisdiction of English Courts
