Waiver, Release of Liability, Covenant Not to Sue & Image Release.


Photography/Video Release:


Participants involved in any activities offered by SC360 Ltd, trading name CROSSFIT MAXON, may be photographed or videotaped during an event or related activity.  The undersigned hereby consents to the use of these photographs and/or videos without compensation, on the SC360 Ltd Facebook page, web site, or in any editorial, promotional or advertising material produced and/or published by CROSSFIT MAXON (SC360 Ltd.) 


Waiver and Release of Liability:


Express assumption of risk:   I, the undersigned, am aware that there are significant risks involved in all aspects of physical training.  These risks include, but are not limited to:  falls which can result in serious injury or death; injury or death due to negligence on the part of myself, my training partner, or other people around me; injury or death due to improper use or failure of equipment; strains, sprains and fractures, heart attacks and strokes.  I am aware that any of these above mentioned risks may result in serious injury or death to myself and or my partner(s).  I willingly assume full responsibility for the risks that I am exposing myself to within the event. I accept full responsibility for providing myself with the necessary kit & provisions I may need during this time for example and not limited to: food, drink, suitable clothing etc. and accept full responsibility for any injury or death that may result from participation in any activity or class while at, or under direction of CROSSFIT MAXON (SC360 Ltd).

I acknowledge that I have no physical impairments, injuries, or illnesses that will endanger myself or others.  I attest that I am physically fit and sufficiently trained to participate in this event. 


Release: 


In consideration of the above mentioned risks and hazards and in consideration of the fact that I am willingly and voluntarily participating in the activities offered by CROSSFIT MAXON/SC360 Ltd, to the fullest extent permissible by applicable law, I, the undersigned, and my heirs, assigns, spouses, partners, personal representatives and/or next of kin, forever WAIVE, RELEASE, DISCHARGE and COVENANT NOT TO SUE CROSSFIT MAXON/SC360 LTD, and their owners, directors, employees, representatives and volunteers (collectively, the "Releasees") WITH RESPECT TO ANY SUITS, CLAIMS, OR LOSS AND ALL INJURY, DISABILITY, DEATH AND/OR LOSS OR DAMAGE TO PERSON OR PROPERTY, WHICH ARE RELATED TO, ARISE OUT OF, OR ARE IN ANY WAY CONNECTED WITH MY PARTICIPATION IN THIS ACTIVITY, INCLUDING THOSE ALLEGEDLY ATTRIBUTED TO THE NEGLIGENCE OR WILFUL CONDUCT OF THE RELEASEES OR OTHERWISE.  


Indemnification: 


The participant recognizes that there is risk involved in the types of activities offered by CROSSFIT MAXON/SC360 Ltd.  Therefore the participant accepts financial responsibility for any injury that the participant may cause either to him/herself or to any other participant due to his/her negligence.  Should the above mentioned parties, or anyone acting on their behalf, be required to incur legal fees and costs to enforce this agreement, I agree to reimburse them for such fees and costs.  I further agree to indemnify and hold harmless SC360 Ltd, and their owners, directors, employees, representatives and volunteers from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in activities offered by CROSSFIT MAXON/SC360 Ltd, at its gym or other location.   This includes but is not limited to car parking areas, roads, pavements, parks, recreational areas, areas adjacent to the main building, and / or any area selected for training by CROSSFIT MAXON/SC360 Ltd.  


If any of the provisions of this Waiver, Release of Liability, Covenant Not to Sue & Image Release ("Waiver") is deemed invalid or unenforceable in any respect, then, to the fullest extent permitted by applicable law,  I agree that the remainder of the agreement shall remain in full legal force and effect.  


I HAVE READ AND FULLY UNDERSTAND THIS WAIVER.  I UNDERSTAND THAT I HAVE GIVEN UP,  SUBSTANTIAL RIGHTS BY SIGNING UP FOR THE COMPETITION, AND SIGN UP TO IT FREELY AND VOLUNTARILY.

This privacy policy explains how we use any personal information we collect about you from our website, visits to our premises, and data entered into the online & mobile applications we use.

Who we are?
CrossFit MaxOn is a trading name of SC360 LTD. Our registered office is at Sunrise House, Unit 3, Hulley Road, Macclesfield, SK10 2LP, registered in England under Company No 9306354.


What information do we collect?


We collect your contact details (name, email address and phone number) and any extra information you choose to provide us in a message when you enquire on our website.  If one of our members makes a booking for you as a guest, or recommends you as a friend, they may provide us with your contact details.


When you attend your first class, as a guest or a prospective member, we collect data on an informed consent form (contact details, address, date of birth, emergency contact details, medical and health information relevant to your attendance at a CrossFit class).  Prior to attending the class, we record your name on a spreadsheet held on a private google drive.


When you become a member, we use the details you have supplied to us orally, on the ICF , or via email, to set up and manage your membership account on our online booking system TeamUp and on our performance tracking system BoxMate.   You are given access to these applications. Each of these third party application have their own privacy policy to protect your online data. In particular, please note that we do not keep any of your financial details ourselves, either on paper or electronically.


We record attendance and no shows at classes on TeamUp. If you inform us of a health or medical condition , either orally or in writing or on the informed consent form, we may, keep this on TeamUp when we deem it relevant to what you do in a CrossFit class.


If you voluntarily contact us we may keep a record of that correspondence and any comments and responses you submit via customer surveys.


We record your name on a piece of paper or in the cash book when you order or purchase an item held at our premises.

We keep an accident book with details of any accidents that may occur on our premises, which includes your name and the nature of the accident.   This is to comply with Health & Safety legislation.

When you visit the gym, your image may be captured on our security system.   We may also take your photo when you take part in any of our classes or social events or competitions.  The photographs are held on a google drive.


How do we use personal information?


If you are not a member we use the information we collect as described above on the basis of our legitimate business interest unless otherwise stated for the following purposes:

  • To respond to your enquiry

  • To ask for feedback

  • To let you know about any services or products that may be of interest



If you are a member, in addition to the above ways, we also use the information we collect about you to

  • Monitor your attendance and usage (data held on TeamUp)

  • Administer our policy on retainer membership or cancellation  (data from TeamUp)

  • Track your progress and for coaching you  (data held on BoxMate)

  • Check on and update any health related issues (data on TeamUp)

  • Tell you about products or services we are selling



What legal basis do we have for processing your personal data?

We hold information about you on the grounds of legitimate interests.   We hold your data in order to contact you about our services that you may be interested in.  We need the health details and emergency contact details in order to provide our duty of care to you when you attend our premises. It is our legal obligation to record details of any accident.



How we store the data

We store informed consent forms in a locked filing cabinet, which is held on our premises, which are locked when not used.


Email correspondence, spreadsheets with names of people coming for tasters or one-off classes, and photographs are stored on a password protected google drive.



Sharing your data

We value your privacy and do not sell or share your information to any third parties under any circumstances. If coaches outside of CrossFit MaxOn run classes, we will inform them of any relevant health issues that may affect what you can do in that class.


Please refer to the privacy policy of TeamUp and of  BoxMate for information regarding sharing of the data held on their systems.




Provide detailed information on all grounds that apply to your processing, and why. If you rely on consent, explain how individuals can withdraw and manage their consent. If you rely on legitimate interests, explain clearly what these are.




How long do we keep your personal data for?


We keep the information that you provide or that we collect only for as long as we need to in line with the reason it was collected. More detail is given below for each category of information.

Non-members and guests:
Contact details of enquirers from our website who don’t respond to our reply within 60 days, are deleted. For other enquiries, including those who attend a class and decide not to join, we keep correspondence (and informed consent forms) up to seven years in case you contact us again.

Members and ex-members:
We keep the data we have collected about you, including  usage and attendance details and information about your personal circumstances during your membership up to seven years after it ends so we can respond in the event of any query about your membership. We may keep certain information for longer than this if we have a compelling reason for keeping it.

We keep details of incidents for three years after the date of the incident.


Data held on paper eg informed consent forms, is shredded when no longer required.


Your rights in relation to personal data

You have the right to request a copy of the information that we hold about you. If you would like a copy of some or all of your personal information, please contact us (see below) and we will respond within one month. We may make a small charge for this service, and may ask for proof of identity. We want to make sure that your personal information is accurate and up to date. You may ask us to correct or remove information you think is inaccurate.


If you are unhappy about how your personal data is being processed please raise your concern with us first  (see contacting us below). If you are not happy with the way that we deal with your concerns you can contact the Information Commissioner’s Office (ICO) at ico.org.uk
